What is Spousal Maintenance?

Spousal maintenance is a regular payment made by one ex-spouse to the other following a divorce, in addition to any child maintenance. There is no automatic entitlement to spousal maintenance, as each couple’s financial needs and income vary. Usually:

  • Interim Maintenance can commence during the divorce process.
  • Longer-Term Maintenance begins once a final financial settlement is agreed.

Who Decides How Much Spousal Maintenance is Paid?

  • Negotiation & Legal Advice: Typically, each spouse’s solicitor will advise on what a judge is likely to award based on financial needs and resources.
  • Court Decision: If no agreement can be reached, a judge will make the final decision on the amount and duration of spousal maintenance.
  • Alternative Dispute Resolution: Couples who prefer not to rely on a judge’s ruling can explore mediation, arbitration, or a Private Financial Dispute Resolution (FDR) session to reach a mutually acceptable figure.
