What is Spousal Maintenance?
Spousal maintenance is a regular payment made by one ex-spouse to the other following a divorce, in addition to any child maintenance. There is no automatic entitlement to spousal maintenance, as each couple’s financial needs and income vary. Usually:
- Interim Maintenance can commence during the divorce process.
- Longer-Term Maintenance begins once a final financial settlement is agreed.
Who Decides How Much Spousal Maintenance is Paid?
- Negotiation & Legal Advice: Typically, each spouse’s solicitor will advise on what a judge is likely to award based on financial needs and resources.
- Court Decision: If no agreement can be reached, a judge will make the final decision on the amount and duration of spousal maintenance.
- Alternative Dispute Resolution: Couples who prefer not to rely on a judge’s ruling can explore mediation, arbitration, or a Private Financial Dispute Resolution (FDR) session to reach a mutually acceptable figure.

Shocked and surprised!
I entered the HM & Co Solicitors on Lower Road in what can only be described as a highly agitated state. I had been told a variety of information from another company and had been told I needed services from a solicitor. After explaining my situation to the gentleman I now know as Mr Hakeem Ayantayo (solicitor) he advised me that I did not need his services and to offer them to me for monetary gain would be against good public practise. He offered me friendly advice and even briefly spoke on the phone to the other company who were trying to make things difficult for me. Ultimately the situation I was in was resolved due to Mr Ayantayo and his due diligence. Mr Ayantayo could have taken advantage of my ignorance and lack of lawful knowledge but instead showed me kindness and support all while not fleecing me! Which in this day and age is a rarity!
